Jai Club - Terms of Service

Use of the site

By accessing or using jaiclubapp.io (the "Site") or any services offered by Jai Club, you agree to be bound by these Terms of Service in their entirety. If you do not agree with any provision, you must discontinue use of the Site immediately. These Terms constitute a legally binding agreement between you and Jai Club and apply each time you visit, browse, or transact through the Site.

Eligibility and account responsibilities

You must be at least 18 years of age to use the Site. By using the Site, you represent and warrant that you meet this requirement and that all information you provide, including registration details, contact information, and payment data, is accurate, current, and complete. If you create an account, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Permitted and prohibited use

You agree to use the Site only for lawful purposes and in a manner consistent with all applicable laws and regulations, including those of India such as the Information Technology Act, 2000 and the Consumer Protection Act, 2019. You must not use the Site to transmit unlawful, harmful, or fraudulent content; attempt unauthorised access to the Site's servers or related systems; introduce malware or harmful code; scrape or redistribute content without prior written consent; or impersonate any person or entity.

Jai Club also supports payments via widely used Indian platforms such as PhonePe, Google Pay, and BHIM UPI, regardless of payment method, you remain responsible for ensuring that transactions initiated from your account are authorised.

Modifications and availability

Jai Club reserves the right to modify, suspend, or discontinue any part of the Site at any time, with or without notice, and is not liable for any such change. Continued use of the Site after revised Terms are posted constitutes your acceptance of those changes. We recommend reviewing these Terms periodically to stay informed of your rights and obligations.

Intellectual property

All content, materials, and functionality on the Site are the exclusive property of Jai Club or its licensors and are protected under applicable intellectual property laws, including the Copyright Act, 1957 (India), the Trade Marks Act, 1999, and relevant international treaties including the Berne Convention. Unauthorised use of any intellectual property appearing on the Site may give rise to civil and criminal liability.

Our content and trademarks

The Jai Club name, logo, trademarks, service marks, and all associated branding are the proprietary marks of Jai Club. Text, graphics, images, audio, video, software, and the overall look and feel of the Site are owned by or licensed to Jai Club. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our express prior written permission.

Limited licence and user-submitted content

Subject to your compliance with these Terms, Jai Club grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site solely for personal, non-commercial purposes. This licence does not include any right to sublicense, sell, or otherwise transfer any content or rights granted herein. If you submit or upload content through the Site, you grant Jai Club a worldwide, royalty-free, perpetual licence to use and distribute such content in connection with operating and promoting the Site, and you warrant that you own or have all necessary rights to grant this licence.

Limitation of liability

To the fullest extent permitted by applicable law, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019, Jai Club and its directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site or its services.

Disclaimer of warranties

The Site and all content, products, and services made available through it are provided on an "as is" and "as available" basis, without any warranties of any kind, express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Jai Club does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Cap on liability

In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, Jai Club's liability is limited to the maximum extent permitted by law. In all other cases, Jai Club's aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to Jai Club, if any, in the twelve (12) months immediately preceding the event giving rise to the claim.
